Court Records of Schuylkill County Regarding Hopkin Thomas

Record No. 3, dated 9/3/1847

These are the deed entries conveying five 20’8” x 130’ lots (149, 150, 151, 152, and 153) located on the west side of Rail Road St. in Tamaqua to Hopkin Thomas. These lots are presumed to be the location of Hopkin’s future machine shop. Note that there is no reference to a partner – Hopkin was the sole purchaser.

Note that the year of the transfer was 1847 and Hopkin Thomas is identified as be “of Carbon County”. This implies that Hopkin had not yet moved his residence to Tamaqua.

Baltimore City

On this 8^th day of September Anno Domini 1847 me the Subscriptor Commissioner appointed within and for the State of Maryland pursuant to the provision of a statute of Pennsylvania entitled an act to authorize the appointments of Commissioners to take acknowledgement and proof of deeds and instruments under seal and dispositions and the supplement thereto personally appeared Thomas Wilson and Julia A., his wife, in and due form of law acknowledged the written Indenture to be their act and deed and desired the same might be recorded as such. And the said Julia A. being of full age and separate and apart from her said husband by me thereon privately examined and the free contents of the deed being by me first made known to her did thereupon declare and say that she did voluntarily and of her own free will and accord sign, seal and, as her act and deed, deliver the within written indenture without any coercion or compulsion of her said husband or any undue influence whatever. Witness my hand and seal the day and tear above written.

Recorded and Examined October 22^nd 1847.

This Indenture made the third day of September in the year of our Lord 1847 between Thomas Wilson & Julia A., his wife, of Baltimore Maryland and William Levan and Mary Ann, his wife, of Pennsylvania of the one part and Hopkin Thomas of Carbon County, Pennsylvania of the other part. Witnesseth that the said Thomas Wilson & Julia A, his wife, and William Levan and Mary Ann, his wife, for and in consideration of the sum of $550.00 lawful money of the United States of America unto them well and truly paid by the said Hopkin Thomas at and before the sealing and delivery of these present. The receipt is hereby acknowledged have granted, bargained, sold aliened, enfeoffed, released and confirmed and by these presents do grant, bargain, sell alien enfeoff, release and confirm unto the said Hopkin Thomas his heirs and assigns All those five lots of ground in the Borough of Tamaqua, Schuylkill County, Pennsylvania being lots No. 149, No. 150, No. 151, No. 152 and No. 153 in Wilson and Levans addition to Tamaqua situated on the west side of Rail Road Street fronting each for 20 feet, 8 inches on said Rail Road Street and extending back 130 feet to a 60 feet wide street bounded on the North by Lot No. 154 and on the South by Lot No. 148 on the East by Railroad Street and on the west by said 60-feet wide street, being a part of what is known as the Baum Tract. Reserving all minerals and the Right of Tunneling, mining and removing the same together with all and singular the buildings ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders rents, issues, and profits thereof and all the estate right title interests, property claim and demand whatsoever of Thomas Wilson and William Levan excepting the reservations aforesaid in law equity or otherwise howsoever of, in, and to the same and every part thereof. To have and To Hold the said five lot of ground hereditaments and premise hereby granted a mentioned and intended so to be with the appurtenances unto the said Hopkin Thomas his heirs and assigns to and for the only use and behoof of the said Hopkin Thomas his heirs and assigns forever. And the said Thomas Wilson and William Levan for themselves and their heirs, executors and administrators do by these presents covenant, grant, and agree to and with the said Hopkin Thomas his heirs and assigns that they the said Thomas Wilson & William Levan and their heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said Hopkin Thomas his heirs and assigns against them the said Thomas Wilson and William Levan and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof by from or under them or either of them shall and will warrant and forever defend in writing whereof of the said parties to these presents have hereunto interchangeably set their hands and seals. Dated the day and year above written.

Received the day and date of the above Indenture of the above named Hopkin Thomas $550.00 the consideration money above mentioned in full. Witness:

On the Fourth day of September Anno Domini 1847, before me, one of the aldermen of the County of Philadelphia, personally appeared the above named William Levan and Mary Ann, his wife, and in due form acknowledged the above Indenture to be their act and deed and desired the same might be recorded such, and the said Mary Ann, being of full age and separate and apart from her said husband, by me thereon privately examined and the full contents of the above deed being by me first made known unto her, did thereupon declare and say that she voluntarily and of her own free will and accord sign, seal and as her act and deed deliver the above written Indenture Deed or Conveyance without any coercion or compulsion of her said husband. Witness my hand and seal the day and year aforesaid.
